The could be the case but M7T management presumably declined. The other possibility is they have been shorting the stock leading up the the announcement of the appeal. If you knew you were going to appeal isn't it easy money to short the stock leading up to the announcement ? However presume this would be regarded as insider trading as the shorter would have sensitive information not released to the market ?
