It's a red flag for me when you are trying to reverse engineer an outcome. He would have been trying to pull together interpretations from legislation that was never intended to be used for the purpose that he needed from it. Given the rigorous scrutiny it is about to receive, I would be willing to bet it will struggle to stand up. Square pegs never fit snugly in round holes.
