I'm sure you're aware that Consent Orders have been made regarding the subpoenae issued on ASX and Visa:
- ASX Subpoena - the Defendants (ISX and Karantzis) are to pay $150,000 as security for the reasonable costs of compliance with the subpoena and in respect of challenges for privilege. (Jud. Reg. Legge, 20 July 2022).
- Visa subpoena - the Consent Order framed similar to the above but requiring $125,000 to be paid. (Reg. Luxton 16 August 2022).
Similar to the outstanding security of $2.69M that needs to be stumped up to get the ISX v ASX proceedings listed for Hearing, I expect that not much will happen on the subpoena front until the Defendants in the ASIC prosecution matter comply with the consent orders and pay the $275,000 forthwith. That will ensure that all document are produced and the privilege arguments are heard in accordance with law. That said, the Hearing is still listed to commence late Feb 2023 and it won't be vacated because the Defendants failed to pay security monies for compliance with a subpoena issued at their request.
Have those subpoena compliance security monies been paid into Court yet? The ASX sum was due on 27 July and the Visa sum was due 15 August.
