in my mind it could have been played fairly:
rights issued but then the options at strike prices of 3, 4 and 5 dollars.
the work done to date and the risks are open to interpretation but they need to get the share price to $5 or nasdaq - chicken and the egg but this is where most share holders are back to break even.
