Any single holding 5% or more is classified as a SUBSTANTIAL HOLDING but the issue you would have is arguing that a collective holding should be classified as the same so it would need to be a class action.
Additionally you would have the risk of CN's being redeemed and the holding percentage impacted making the whole process prone to risk of being irrelevant IMO
