    .... I didnt think there were any further avenues of appeal for BHP?

    Got to accept the umpire's decision at some stage. Imo, if they push too hard they may win the battle and lose the war as westcott pointed out.

    3rd party open rail will bring on stream many projects that would otherwise remain stranded. now there are a couple of big players, eg BRM, with enough ore to justify own rail, you would think that strategically it would make sense to lock them into BHP rail and "prevent" competitive rail being built that may blow the whole of the pilbara open. food for thought
