yes, they can issue or lodge a prospectus at anytime, in fact, they could do a SPP without a Prospectus or they could do a placement to sohisticated and/or professional investors without a prospectus however, if they issue more than 15% of issued capital (number of shares) within 12 months they will need shareholder approval unless this has been obtained in advance at a General Meeting of Shareholders.
