To date, one of the companies that has assets in the salt flat, Simco -linked to the Errázuriz group and Simbalik- came out to claim the effects that a possible change in the legal interpretation regarding mining property would have.
"The company, relying on the acts of the Chilean State, invested large resources in the development of a technology that would allow a sustainable use of the salt flat and repeatedly offered to share this technology with Codelco or with any other State company," he said. He added that a scenario like this could delay the production of lithium and the increase in value in new deposits and the incorporation of new actors, in addition to the fact that it could represent for the state the obligation to pay damages for damages valued at more than US$2.5 trillions.
"This eventual reinterpretation would constitute an expropriation without payment, which would seriously affect the confidence of shareholders and investors and would force us to sue in international courts, in accordance with current foreign investment protection treaties," Simco warned.
