I imagine the CEO will ensure that the "tender offer" will comply with all aspects of the Companies (Acquisition of Shares) Code and ASX Listing Rules. After all SWW is still a public company and listed (albeit suspended) on ASX. If there is indeed an offeror then the documents will need to be lodged with ASIC prior to mailing.
