The damages would be payable to those who suffered from the Government wrongly approving the Water Licence. As this is not what OCAA wants it will have to find a way to seek an injunction to restrain NHC from operating but as NHC has done nothing wrong I fail to see how OCAA would be successful. If an injunction were to be granted normally the Court requires that OCCA (in this instance) be financially able to meet damages that NHC would suffer from not being able to mine while the case continued.
