Nigel has already indicated at the RS's that we won't be negotiating with Zijin or anyone else that doesn't have legal entitlement. You don't negotiate with parties that try and get a piece of the action through corrupt processes. Nor should we listen to anything that comes from AFR. They have already indicated which side of the fence they sit on and it isn't with the interests of us Shareholders.
IMO Comminere will ultimately have to withdraw the deal done with Zijin. Why.....because it was done without authority and was not in the interest of the DRC people. IGF has already proven this and the people will want this independent process ratified with actions by the President. Also, AVZ's legal action to confirm its ownership status will succeed as this is supported by IGF. Comminere won't want to defend their actions.
Zijin will withdraw their legal case on the steps of the Paris court and not before. Why... They will exhaust all avenues to get AVZ to come to the Table but as I have already indicated AVZ doesn't have to do this and Zijin has no claim on AVZ. The 15% was our first right of refusal.
AVZ management know and have informed all Shareholders we own 75%. Yes, we might have to pay more for the remaining 15% from Comminere but this is where the negotiation will take place and this is what needs to happen soon. The President will be demanding this. Comminere will have to pay back Zijin. Who do you think will have to pay for that? Obviously AVZ will have to trump up the extra cash to get the 15% and cover the corrupt dealings of Comminere so it restores confidence in that entity with the people.
AVZ management will not and does not have to negotiate with players that have no legal interest in Manono. I support our Mgmt team in this regard. I listened to many SHs at the RS who called for AVZ management to give up 15% or pay $50M to advance its course and move the project on. this. That is a weak strategy and would not advance our entitlement to the ML or our ownership status in the DRC. We have done all that has been asked and our legal entitlement has been validated through the proper channels.
Long term Shareholders should remain steadfast in the belief that AVZ will prevail and succeed in its Mining Licence and Ownership status even if it takes another 2-3 months.
