Given the delay to accomodate Peak for over a year.
I would've though some adjustment to the JV economics would be fair.
There should be a concept of a dilutionary penalty to the party not able to perform.
This should be backstopped with a drop dead date that allows termination if we go past.
Shareholder's should appropriately protected from the opportunity cost of partnering with the wrong party.
If a party is proven to be unable to perform, it should not continue to have a free option.
