If ALB wants to accumulate on market, they are free to do so up to the takeover threshold of 20%. If they exceed that they are obliged to launch a formal takeover offer for all of the shares in the company...they would be required to make their bid at not less than the highest price paid by them at any time during the previous 4 months. Given the short seller situation it may be very difficult to gain a significant holding of even 20% without the share price going ballistic.

Partial takeovers would require a resolution to be passed by shareholders as per schedule 5 of the company constitution...this provision was inserted at the 2021 AGM with the objective of preventing any suitor gaining control without paying a control premium.

The stage looks set for a chaotic period for our shares...I'm sure nearly all of us here will continue to hold tight. Step up Mr Goyder (and advisors) to lead us through this and send ALB packing!
