Yes, no record of Lynas appealing the conditions when they were applied in 2020. Even though we know the conditions are unfair and should never have been applied, the timing of the appeal so close to the July deadline, with Kal not yet operational, could well appear as an act of desperation. Obtaining an extension is not the answer, the conditions need to be removed and LAMP C&L should continue permanently. Kal operations should double, not replace LAMP output. Lynas should have railed against the onerous conditions from the outset.
