well whats "the law" that requires them to approve it? the court never remotely said SM actions were "illegal" thats just become the facts from it being said so many times here.
The JA can make any decision they want to. The government sets policy NOT nopta. If the government decides that they don't want drilling at PEP11 then they will decline the extension.
What they can't do is bring an obvious bias to the decision making. for example If madeline king wanted to approve it and was going to for instance, then Albo replaced her with a minister willing to decline it then again we would have subversion of the system and a case for court action.
If she takes into account all the advice and simply denies it and the NSW minister also declines then good luck with any action.
We have no automatic right for an extension. Why do you think we would?
We had a permit, it expired and we didn't get things done that we needed to do in the time.
If this was a lay down approval then the SP would be well north. Its not because its not remotely a certainty. The PM has publicly stated he is against it so thats a major hurdle.
trying to keep pushing that its a "binary decision" is just misleading along with all the other half truths like "illegal actions" , "unconstitutional" etc etc.
its a big punt. Thats why the upside is so big because the SP is not factoring in approval at the moment at all. if people want to take the risk thats great but people should NOT think or be told constantly that its a certainty.
