    they did not find the decision illegal. That is completely wrong. The court approved the consent orders.
    No mention in the judgement at all of anything being "illegal" or "unconstitutional". That is your extrapolation of the court decision.

    There is no question that SM's actions were incredibly unsavoury and not remotely within the spirit of the functions of government but definately NOT illegal.

    No question that he bought an apparent bias to the decision because from any reasonable outsider it looks like he appointed himself (legally) to be minister of resources specifically to decline the PEP11 application. So that was BPH's case and pretty good.

    Why you think the JA can only now make one decision is just illogical. The government can set whatever policy it want with this matter as long as it doesnt subvert the process.
