The problem with a class action is, it is costly to fund a case. You could get somebody like IMF or Gordon & Slater to fund the case just like how they are funding the case against the banks for excessive fees. But before pursuing any case, they will look at the likelihood of recovering damages and fees if they win their case against the company. Even if they win the case against the company, the company might be an empty shell unable to pay its debts.
My only hope is that NBS's largest shareholder Orbis, put up a fight against NBS. They have the wherewithal to fight this company and I understand that they are a litigious bunch, but NBS is only a drop in the ocean for them.
