the Mining Code doesnt specifically say that Cominiere need to cede 10% to the government. Just that 10% needs to be held by the government. Its the Dathcom Joint Venture Agreement that says Cominiere will be the one to cede that 10%. May amount to the same thing, though Cominiere is attempting to dissolve that JVA at the ICC as per latest shared Jin Cheng / Cominiere motion.
