ASIC appears to have made a focus on four themes in 2021 or 2022 and Design and Distribution Obligations is one such thing.
In AMEX's example they say there was a high cancellation rate of the credit cards and complaints so they should have reviewed target market to not have cards to such cohort of customers. It appears if HUM can work to amend the Target Market Determination for what ever issue ASIC has they could go back to selling, from reading some cases related to Super Funds and the like where this is addressed or ASIC does a full vs interim stop order.
