help can someone explain!!

I just read the late announcement released today 27/7 by MLS regarding issuing another 150 million shares plus options. What I would like to ask my esteemed fellow posters that frequent and chat about this stock is the following:

Why would you announce this fund raising now and not wait for the outcome of the appeal in Africa? Is is because they think they are going to lose the appeal? Remembering that in all their media releases they have continually been telling shareholders that they believe they have a high probability of success. If they have such a high probability of success then why issue all these shares at at a ridiculously low price now? Wait to see if you win and you could issue them at a much higher rate. They are doing themselves and all their long suffering shareholders an in justice. All this capita; raising will do is force the price of the shares backdown AGAIN.

Also what does this dillution mean to the overall value of the MLS business and value to existing shareholders. Can someone see this announcement as a positive in anyway because unfortunately I can't? I know this proposal has to be approved by shareholders first but normally if the board want somethoing it tends to get through!
