Yeah it's definitely not necessary to go into a TH, but there's nothing stopping a company from doing so to generate a bit of froth hahah
When other stocks have gone into TH for bad FDA news, it's always after they receive the news in order to come up with some excuse for failing. Pretty clear BOT has not yet received any news from the FDA
