You could look at this dispute like this. If I gave a mate $10 a half entry on a lotto ticket and that ticket won first division then I would be requesting half of the winnings. If I wasn't provided with half then I would be taking legal action to claim half.
If the winnings were placed in a bank account for say 5-6 years whilst the dispute was settled then I would be additionally seeking to be compensated for half of the interest earned during that time.
