Personally, the light switched on after the quarterly (yes, very slow).
IMO there probably won't be a case against them unless you can prove they've deliberately mislead/fabricated elements of the announcements which caused a substantial loss to you (that last part should be easy, unfortunately).
Companies, lawyers and accountants use words very carefully. "Should", "could", "expect to" are get-out-of-jail "absolve liability" clauses.
