BHP will no doubt have some price participant mechanism to share in the current very high spot prices as they won’t want WHC to come back in 12-24 months and say the assets are already paid off without BHP getting anything further (this has happened to BHP before).
This in combination with the rehab liabilities will have given WHC some headroom to push for lower upfront consideration.
