Of course they could have. There is no dispute that insider information is available to all sorts of people. Its just not legal to trade on it. Are you seriously of the opinion that the first time anyone at the FDA or IMU knew anything about fast-track approval was today?
I'm not changing my vote, just trying to clarify the scenario for those that haven't voted.
