Dutton, should have, issued NZVQ a protection visa and then should have, allowed NZVQ to be prosecuted as an Australian, then detained as an Australian..
However, Dutton chose populism over the law and with the stroke of a pen, continued to detain NZVQ ( to appease voters like yourselves ) knowing full well that it was running the gauntlet of the law, as NZVQ was actually stateless..
Conclusion, if we want to see criminals lawfully prosecuted and incarcerated and only if they are stateless and repatriation is not an option and without leaving a gaping hole through which they can appeal, we are better off, using visas etc etc to bring them under the umbrella of Australian law and then, prosecuting them.
The LNP are the architects of the detainee release fiasco, not the ALP
