not true. as a litigator from a previous life there is a procdure open to plaintiffs to obtain quick and cost effective judgment. this is precisely a mechanism designed to stop one party from stringing the case out with little or no defence. effectively cfe will need to show that mcc could not succeed in defending its claim. that is not to say that mcc simply by advancing a case will not have judgment entered against it, but that in must be more than possibility of succeeding. the costs to cfe wld be less than 1 mil. easily, and i wld expect if they took this route it wld all be over by xmas. but i dont even think they will go that far. this is simply a tactic designed to extract a debt. its a positive in my books, cfe's way to crystalise both a time and method of payment. load up.
