Well, it's not exactly a new process.
Linc Energy were referred to the EPBC by the QLD govt. and had to get an EIS done.
Justyn Peters worked at Linc Energy so he'd been well aware.
They just gambled on the SA govt not referring the project.
Which is a risky bet because stage 1 would have almost certainly been referred (and it was).
