the gripe by the new landowners post 2008 they must have got wind that Gue who bought the rights from previous owner plans to do work there and they have no rights to sell and apparently could have got land cheaper

if there not happy they can buy the rights back according to this article
anyway that’s my understanding

Yep, while very messy it appears all is legal with respect to GUE's position.
But kind of a dog move on the part of the mineral rights sellers in 2008, they had their cake and ate it too.
