can’t be contacted out of hours now so won’t pick up shifts and the business will be shorthanded
I don't think that is how it works.
The right to disconnect means that you can't be sacked for not responding to after hours contact.
You have the right to be left alone during leisure hours if that is your choice.
I worked for a large company once as a salaried employee and was paid an extra allowance to be on call to answer emergencies.
Can be a bit inconvenient if you've been partying and drunk.
