Some of us here are focusing far too much on this one court case. Reasoning being that Xstrata is looking at the bigger picture and perhaps will not consider Garatouw on its own.

I disagree. Garatouw on its own is a world class project in its own right. Also, the key assumption being made is that this court case is the one and only court case against Genorah for now and into the future.

How do we know if someone else will not come along and lodge another court case, even if the case is as ridiculous as the one currently being heard? Do you think Xstrata will wait around for all potential court cases to be heard? Do you think this will be the last legal action that Genorah will face? Do you think NKP will accept from Xstrata time for the court case to be finalized? I would say most likely not.

The time for Xstrata to put its money where its mouth is ala organic growth statements is coming very quickly.

The key for NKP is to deliver the BFS. I am hopeful of this in the next 2 weeks.
