Yanukovych planned his escape, agreed with associates to "make it look like" he was making a visit to east Ukraine. He took two attempts to exit Ukraine after first being DENIED exit rights. He did not notify authorities of his whereabouts. He remained uncontactable.

These are the actions of a man who has no intention to remain president of Ukraine.
The constitutionality, or not, of what happened AFTER Yanukovych abandoned his presidency is not the point, he had already made the decision himself.
The free and fair general elections Ukraine held months after Yanukovych abandoned the presidency and fled to Russia solved all such issues.
