Fat Tail Dispute As announced on 18 December 2023 and 13 March 2024, the Company is continuing to vigorously defend the claims made by Fat Tail in the Supreme Court of Western Australia proceedings. The parties are currently addressing interlocutory issues regarding the process and next steps in the proceedings, """"""which will include Fat Tail being asked to provide security for the defendants’""""""" legal costs and to enter into a confidentiality regime in respect of any confidential and commercially sensitive material provided by the Company.
Fat Tail may also seek that the Company deal with what Fat Tail says are issues with the Company’s defence.
Unless the parties can resolve these matters by agreement they will be heard by special appointment on 17 June 2024. Fat Tail is required to file any Reply no later than 7 days following the resolution of those matters.
