Because none of them have individually breached creep provisions, nor did Glennon + Tony Jones. It's only by including Brent as an associated shareholder. They can just pull the request, then re-file post the acquisition.
This can just be called again, so long as they don't acquire more shares after making the application. Alternatively, they can still win with only 20% of shares to vote with.
