How about a monthly limit?
Say 30.
And if you go over it, fine, there will be no more posts for you until the 30 day period has finished.
Posters will guage the importance of a TOU in that case and know that thier 'days are numbered' for TOUing.
That way, if a poster is deemed to have legitimately abused the system, they can ALSO be suspended.
