The over riding issue is the legislation lacks time to make a decision.

It is why when scomo decision was quashed, the judge did not and could not set a time frame.

If this gets knocked back again, goes to court, the same thing will happen.

The court in a verdict can only work with law, not create there own law or alter law.

If a judge said, 6 months. The gov says, your honour, the legislation you a relying upon does not give you that option to enforce.

Its a bad bit of legislation as when drafted should have had a fair time to decide on the government's side.

It is why excessive delay can not be won and why dB has not put lawyers onto it, or he would have I feel.
