I read the messaging as more of a risk mitigation for shareholders/prospective investors rather than not 100% they will get approval.
There is always risk that approval will not be received, you're correct in that nothing is 100% until it is. But this can give the market a higher level of confidence than if they pushed forward with the same announcement before approval and without a fail safe
