Well they can panic, or they can spin this as a "win" for energy supply to the East Coast of Australia.
They had a pretty stupid low chance of success strategy to begin with, so this path was inevitable. When a tiny small cap company like BPH can put this much pressure on you when you've had ample time to prepare, you know you screwed up. This likely won't even go to court so it'll cost BPH almost nothing to get what they want. This is the path of least resistance, I've no idea why Labor wanted to go the other way, I can't imagine the influence they gain by banning PEP11 would be that significant.
