Seems to me that it was something - initially - more along the lines of ….any discussion or negotiation relating to this indicative proposal will require a confidentiality agreement; here is a draft for you to review….
Followed by something that was reported to the market as “will not proceed any further with the proposal”.
They may well have told EnergyX something as blunt as you suggest (probably would have, imo!), but I don’t consider it appropriate that they would communicate that publicly.
