Judge Jackson was pretty scathing of the previous government….denial of natural justice , etc. I would imagine that after his last judgment she is not going to be happy to see the present government have effectively ignored her determination, by not making a timely decision.
IMO the government will either see common sense and make a decision on PEP 11 one way or the other before this gets too far down the track. Another alternative is to drag the matter out to a more political opportune time and then make a decision. The further from the forthcoming general election the better for Labor.
Less likely, but still possible, is to make overtures to the PEP11 owners and offer to make an out of court settlement .
Of course the judge could rule for the Government to make a decision within 45 days.
If they are completely bereift of common sense they will fight the matter to the end and possibly cost the taxpayers untold millions in costs and compensation.
Hopefully, the Government could surprise all and approve PEP 11 and provide much-needed affordable gas to the East Coast of Australia. The sooner the better.
