The $30m from Rick Rule has CP's of definitive agreements and FIRB approval. You can bet the agreement has a material adverse effect (MAC) clause which allows RR to walk away or, at the very least, re-negotiate the terms of the debenture if such an event occurs. IMO Rick's next move on the debenture will be telling in terms of how difficult a position SVL is in.
