The SIA document mentions that the Independent Expert's Report will be included in the Scheme Booklet to be lodged by late September.

Taking this one step further, it would be difficult (IMO) for the IE to conclude the Scheme is in the best interests of the shareholders if the DFS has not been published prior to the Scheme Booklet being lodged.

Even if the DFS was lodged within the September quarter, time will definitely be against the IE to determine if the DFS will have enough "value add" to the current bid that they find themselves concluding that the SIA is not in the interests of shareholders.

In summary, the sooner the DFS is published, will allow for the IE to be in a better position to make an informed decision as to whether the bid is fair and reasonable (in the interests of shareholders).

As I'm a mere bush lawyer, is there a more informed person who can advise if a Scheme Booklet can be altered (to include the DFS) prior to either the First or Second Court Date?
