Your logic and reasoning doesn't stand up to much scrutiny. If the class action litigants "chickened out of going to court", then they wouldn't have walked away with a settlement payment from the insurance company. And the insurance company wouldn't have paid out if they didn't think they would lose if they tried to defend the suit in court court... and the company wanted to avoid a damning judgement against the way they promote themselves to investors.
