you need to understand the law properly. Check the stars on findings based on family violence. The standard of proof is high. It’s called the Kennon claim. Its application is strict and while different judges may vary slightly there have been so few cases found under this precedent that it’s a bit of a long bow to make the comment you have made.

just because someone makes the claim - true or not - doesn’t mean the case is successful.

I made a Kennon claim - the first my barrister had ever made but because I had never told a single soul what was happening and all I had was photos it was not found in my favour.

I had never talked to the police until the last incident, and too late afterwards. I had explained the breakdown in my mental health as workplace stress and I simply faded to nothing. It was a huge lesson. My advice to any woman is don’t wait to court and the inevitable breakdown in the relationship to tell the police, even if you don’t press charges. The same would apply to men

while most jurisdictions define family violence quite broadly it is mostly impossible to administer. They don’t chase financial abuse as it is an enormous amount of work. And so on

at the time it bothered me and there have been long term implications for me but as time passed (and not that much) I thought that take emotion out of it and much makes sense

the law is designed to stop innocent parties suffering but the result is that the guilty may get a free pass.
