If I were NUH I would push back claiming that the Default was caused by RT not signing the commercial agreement thereby nullifying any chances for operating profitability that would have been used to service and eventually repay the RT debt.
RT is, therefore, directly responsable for the lack of cash flow and as a consequence the Default clause should not apply.
Perhaps RT, purposely, did not sign the Commercial Agreement which killed NUH's cash flow thereby, most surely, placing NUH in default so that RT could take over all the technology for peanuts..
Not signing the Commercial Agreement was self-serving and intentional in order to create a default by NUH.
It might have been planned all along by RT....
