I agree, I doubt Asset looses this litigation.

The issue nsw has is the juristiction.

The oppgs is a defective piece of legislation in the sense state and federal decide a federal matter.

The issue arises when permit works are in federal waters only with state input.

The state decision is not legally binding, whether it is an approval or decline.

What nsw should have done is decide automatically being outside there legal jurastiction.

The federal government knew works were only in federal jurastiction, so had a duty to inform nsw and move the decision to federal jurastiction.

As the decision is with state, the federal government did not act when they knew only federal jurastiction applied.

Both to me are potentially guilty of deralict of duty.

Evidence, disovery will be final for both parties by 28 October.

I'd expect a mention, late september.
