This ConCourt action came about because there is conflicting belief as to which party represents the Community on the 2 farms.

We have Genorah with some sections of the Community backing it against Beng Minerals with another section of the community backing them. Genorah applied first and were granted the rights. Beng Minerals camp, according to ConCourt decision, were not given proper process or opportunity to appeal this decision because of various DMR actions or inactions, plus Genorah did not consult them.

Their legal challenges were denied until the ConCourt case.

Now, in short, the onus is on the DMR to sort out who are the proper owners etc and awarded the rights. I think this time they will undergo a detailed process. So, will whoever misses out have 180 days in which to appeal the decision? And in Genorah's case they will have some compensations claims against DMR if they miss out entirely. Following this can further legal actions be taken in Higher Courts? It can get quite messy and lengthy.

Now I had to read Nkwe's announcement several times as I don't think anything has been clearly clarified..

PL does not make it clear that the Claimant in the ConCourt case is not one of "the relevant communities" that have met and resolved to proceed with a new application to the DMR. I'm just a little concerned that he did not spell this out.

The legal advice which suggests Nkwe's 64% of the rights may be preserved in any event may or may not be correct. They also had legal advice for the ConCourt case which they thought would be dismissed. PL did not even bother to let Shareholders know that the ConCourt case was happening.

I know that the ConCourt case does not affect Garatau but now there are media reports that Anglo/ARM have initiated legal processes re: Genorah rights to all 5 farms (Garatau/Tubase). PL reply was that ARM has no standing singularly...etc. What about Anglo/Arm together?

I'm afraid I have become a little more cautious with regards to NKP. Info has not really been forthcoming until the S hit the fan last week and still no categoric answers in my opinion.

Sold half my holdings but will buy back if all clear on Garatau soon.
