BY CONSENT, THE COURT ORDERS THAT:
1. Pursuant to r 9.08 of the Federal Court Rules 2011 (Cth), the third respondent is
removed as a party on the basis that it has been unnecessarily joined.
2. The matter is listed for a final hearing of an estimate of one day on a date to be fixed.
3. By 4.00 pm AWST on 14 October 2024, the respondents must file and serve any
evidence upon which they intend to rely at the hearing.
4. Any application for discovery must be made before 4.00 pm AWST on
21 October 2024.
5. By 4.00 pm AWST on 28 October 2024, the applicant must file and serve any
evidence upon which it intends to rely at the hearing by way of reply.
6. By 4.00 pm AWST not less than 28 days before the hearing, the applicant must file
and serve:
(a) an outline of written submissions in chief of no more than 10 pages in length;
and
(b) a list of authorities.

7. By 4.00 pm AWST not less than 14 days before the hearing, the respondents must file
and serve:
(a) an outline of written submissions in response of no more than 10 pages in
length; and
(b) a list of authorities.
8. By 4.00 pm AWST not less than 7 days before the hearing, the applicant must file and
serve:
(a) an outline of written submissions in reply of no more than five pages in length;
and
(b) a list of authorities.
9. All outlines of submissions are to be easily legible using a font size of at least 12
point and one and a half line spacing throughout, including in any footnotes and
annexures. Italics or underlining must be used for legislation and case citations and
boldface or italics may be used for occasional emphasis.
10. By 4.00 pm AWST not less than 3 days before the hearing, the parties must file a joint
bundle of authorities in electronic form as follows:
(a) in portable document format (pdf);
(b) paginated and capable of being searchable for specified text;
(c) in a form that complies with the Federal Court of Australia’s General
Practice Note: Lists of Authorities and Citations Practice Note (GPN-AUTH)
(21 September 2022);
(d) have each entry in the index bookmarked; and
(e) set so that when opened:
(i) it displays at 100% zoom; and
(ii) the bookmarks menu is displayed.
11. Liberty to apply on 3 days’ notice to the other parties.
