If NUH comes out of VA a new interim board will be appointed, after what has happened, Miller wont be back, he effectively misled the market
I will give you a few examples
1) the Bergen CN term sheet was not correct and ommitted a key fact
2) his language around the commercial agreement changed from its being negoitated to “cannot discuss as it is commercial in confidence” , implying he had an agreement, it was never finalised and up until the VA announcement was not executed
3) statements and preview of the 4 gen product and the “launch” at the CES, the chip was not completed until May 2024, therefore what he was showing us was not the product but a prototype which is also why he could not “launch” it at the ces
4) the continual statements about some OEMs being well progressed and the lodging of the fda for the 4 gen, none was possible without a signed agreement with Realtek, he had no agreement, therefore his statemenr are very questionable
5) the definition of POS changed without any explicit statements
And there are a number of others of his questionable behaviour
Whatever happened , it appears the Realtek relationship soured under Miller and Miller continually misled by ommission
This is not a defamatory statement, its all documented, eventually he could not spin his bs anymore. He will try to avoid court at all costs.
