There was plenty of disclosure that the High and Supreme courts had turned down the two previous claims.
The CONCOURT is the one where the damage was done but that is not set in platinum yet. Nkwe will fight and win. Nkwe had consulted the right community.
The SA government is to blame for advising Generoh/Nkwe that they had completed their consultation process inter alia, by awarding the permit. The High and Supreme Courts backed up their Department of Mines decision to grant the permit.
THat is the core of the matter.
The CONCOURT reversed back over their own Mines Departments and two other courts' decisions based on a faulty claim by a smaller subsection of the community than the Rhoka. The Rhoka were consulted and have written an open letter exclaiming their satisfaction.
Nkwe will sort out this poor decision making through the courts once again. The minor community that came forward to make claims after the event, remain the minor community with minor interests.
Shorters will remain short of money, imo.
Shareholders will get their money back and more if there is justice done in SA.
